GENERAL TERMS AND CONDITIONS

1. Packing Information:

Standard package quantities are shown on individual pages.

2. Shipping Terms:

Prices are f.o.b. Shakopee, Brooklyn Park, and St. Paul yards on material in stock. Customer trucks for plant pick-up orders should have open tops for mechanical loading. Our plant hours are between 7:30 a.m. to 4:00 p.m. Monday through Friday. Freight is prepaid on shipments direct from the treating plants. Minimum truckload weight is 42,000 lbs. Minimum less than truckload weight is 22,000 lbs. Check your catalog for full truckload and less than truckload pricing. Deliveries out of Twin City yards are based on an hourly charge of $100.00 per hour, 18,000 lbs. maximum.

3. Material:

Landscape timbers are cut from select, sound, live pine timber. They are graded to full size and double end trimmed. All materials are air dried or kiln dried and pressure treated in strict accordance with the specifications of the American Wood Preservers Associations and the Federal government. Geotextiles, steel and concrete products are to be free from defect in material and workmanship. Wheeler further warrants that its products conform to the specifications published in current sales literature. If a Wheeler product is defective or does not meet our published specifications and our customer gives notice to Wheeler before installing the product, Wheeler will replace without charge to our customer or refund the purchase price at Wheeler’s election.

4. Returned Goods:

Returned merchandise will not be accepted without prior authorization by Wheeler and deductions from invoices for shortages or damage claims will not be allowed. All returned merchandise is subject to a 50% restocking charge for handling and repacking.

5. Conditions of Acceptance:

All orders are subject to acceptance by our office. Price, discounts and terms are subject to change without notice. All orders accepted will be shipped on the basis of prices prevailing at time of shipment.

6. Terms of Payment:

The terms of payment are 2% - 10 days ADI net 30 except for special early order discounts and direct sales where no 10 day discount may apply. The above terms are only for customers with established lines of credit. All other orders will be strictly COD. Net cash upon delivery or pick-up. Wheeler reserves the right for a credit check or certified funds in advance before shipping and COD order.

7. Late Payment Penalty Charge:

A charge of 1-1/2% per month (18% per year) or the maximum rate permitted by law, whichever is less, will be imposed on past due accounts.
